According to Regulation (EU) 679/2016, the patient benefits from the right of access, rectification, portability or deletion of data, restriction of processing, the right to oppose processing, the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent prior to its withdrawal, the right to lodge a complaint with a supervisory authority. In order to exercise these rights, the patient may contact the Data Protection Officer.

In order to protect the data provided by its customers or the persons with whom it interacts through its website and/or its call center, SC Albi Dent Expert SRL continuously monitors and ensures that the processing of personal data respects strictly the principles and legislation on the protection of personal data, the provisions of Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing of Directive 95/46/EC.

This Privacy Policy is effective from May 2018 and is intended to inform you of your personal data processing activities as a Visitor of the Site or a user of the Web site's functions, community. The processing of personal data is carried out by SC Albi Dent Expert SRL, in order to carry out its activities, as described below. SC Albi Dent Expert SRL may update this Privacy Policy later, in which case it will inform the data subject through the webpage of any changes before they become applicable.

"Transmitter" means the physician who recommended/enrolled in medical referral for medical records.

"Company Customer" means clients registered on the basis of partnerships or service contracts concluded by SC Albi Dent Expert SRL with various categories of entities.

"Direct Customer" means clients who submit to SC Albi Dent Expert SRL either directly payers or customers requesting the performance of analyzes settled by the Health Insurance House.

"Processing" (and its derivatives, including without limitation "processing") means any operation or set of operations performed on Personal Data, including without limitation the collection, recording, preservation, modification, use, disclosure, access, transfer or destruction them.

"Online Programmer Users" refers to people who use the feature available on the Site to order medical services from SC Albi Dent Expert SRL's offer.

"Visitor" means any person accessing or using the Site.

The personal data categories processed depend on the context of the interactions and relationships you have with Albi Dent Expert SRL, respectively in relation to the interactions with the Site. Thus, SC Albi Dent Expert SRL could process the following Personal Data Categories:

  • Company Clients: to provide laboratory analysis services and online access to medical analysis results: user and password for the web account, medical analysis results bulletins, e-mail address.

With regard to other data processing of the Patients made by SC Albi Dent Expert SRL within the medical act, through manual and automated systems, including for improving the quality of our services or for direct marketing activities, more information has been provided and is available the persons concerned through the Data Submission Form for the purpose of preparing the request for analysis and the Data Processing Note.

• In the case of Referral Physicians, the following Personal Data of the Dispatcher are processed:
  • for online access to the results of medical analyzes made to clients for whom the doctor has provided the referral when the patient has requested Albi Dent Expert SRL to transmit the results in electronic format to the Sender: name, surname, firstcode, CNP, e-mail address -mail, user and password for your web account;
  • for the performance of medical analyzes, the management of health systems and services by SC Albi Dent Expert SRL, in the context of providing the results for the analyzes included in the medical referral: name, first name, CNP, initial code, signature, profession, medical specialty, e-mail address, phone.
• In case of Company Clients: name, surname, CNP, e-mail address, phone number, post/function, city, CV (which may include, among others, the following data in addition to the above, image, training, information on the current job);
• In the case of potential Company Clients, such as, in the context of requesting a bid: name, first name, e-mail address, telephone number, representative function and/or contact person;
• For subscribers to the Newsletter: name, first name, e-mail address;
• In the case of persons who contact SC Albi Dent Expert SRL through the Call Center, other telephone numbers displayed on the Site or other means of remote communication belonging to SC Albi Dent Expert SRL, in the context of:
  • schedules for laboratory analysis services settled by the CAS, the following Personal Data may be processed: name, surname, CNP, insured quality, medical referral, date of birth, telephone number;
  • telephone calls of Direct Paying Patients, the following Personal Data may be processed: name, surname, CNP, medical referral, telephone number;
  • requests, complaints and telephone suggestions as well as those sent by other means of remote communication, the following Personal Data may be processed: name, surname, CNP, home address, telephone, e-mail address.

Purposes and grounds of Personal Data Processing

Personal Data relating to the categories of individuals referred to in the above section voluntarily provided on the basis of the relationship with the Holder, the creation of the web account, the request for offers, the completion of the online forms, the online medical analysis order, the improvement of the services, subscribing to the Newsletter or otherwise provided by the use of the Site or in the relationship with SC Albi Dent Expert SRL may be processed by SC Albi Dent Expert SRL directly and/or through its empowered agents for the following purposes:

• For the purpose of concluding and executing contracts, for the following purposes:
  • in order to retrieve and process order analysis commands placed online by users of the Order Command within the Site (by accepting the Terms and Conditions of Use of this feature on the Site);
  • the execution of the contracts regarding the provision of medical assistance, concluded with the Direct Clients of SC Albi Dent Expert SRL;
  • transmission of personalized offers to the contact person/representative of the legal person who has requested the healthcare offer;
  • with a view to concluding contracts - in the context of data processing for telephone calls requested by Direct Patients or other means of remote communication;

The legal basis of these processing activities is the conclusion, respectively the execution of the contract.

• In order to fulfill the legitimate interests of SC Albi Dent Expert SRL in the context of its object of activity;
• In order to improve the services (such as asking for feedback), handling requests/complaints received from you, personalizing the services at the request of the data subject and submitting necessary analyzes - in the context of data processing of site visitors;
• In order to provide the requested medical services and to transmit the results of the medical analyzes to the Company's clients;
• For the purpose of transmitting the results of online medical analyzes to sending doctors;
• In order to achieve the medical services, the management of the health systems and services by SC Albi Dent Expert SRL - in the context of data processing of the Transmitting Physicians;
• For recruitment purposes - in the context of processing candidates' employment data;
• For the purpose of managing appointments, complaints, suggestions, or any telephone requests.

The legal basis of these processing activities is the legitimate interest of SC Albi Dent Expert SRL to improve its services, to manage the requests/complaints received, as well as to adapt the services necessary for each interested person, to provide the health care services, the management of the systems and medical services, respectively to recruit staff.

• For marketing purposes, for the transmission, by means of remote means of communication (eg e-mail, telephone) and through other digital communication platforms, Newsletters or other commercial messages regarding the products and services of SC Albi Dent Expert SRL, and the companies that cooperate with SC Albi Dent Expert SRL, to the clients.

The legal basis of these processing activities is your consent. Your agreement for direct marketing activities can be withdrawn at any time. Withdrawal of your consent will take effect for the future without affecting the legality of the processing carried out before the withdrawal.

It is possible that, after meeting the legal archiving deadlines, the Customer will have anonymity of the data, thus depriving them of their personal character and continue the processing of anonymous data for statistical purposes.

Starting May 25, 2018, when applicable, the GDPR becomes applicable, the data subjects also benefit from the following rights:

• the right to restrict processing to the extent that the conditions provided by law are met;
• the right to data portability, namely: the right to receive personal data in a structured way, which is usually used in an easy-to-read format, as well as the right to transmit these data by SC Albi Dent Expert SRL to another data controller, to the extent that the conditions provided by law are met;
• the right to withdraw its consent when there is a processing based on it; Please note that in case of withdrawal of consent under the applicable legal provisions, when such an agreement has been previously expressed for direct marketing activities, SC Albi Dent Expert SRL, after having noted this, does not will also send direct commercial messages.
